Scope and who is responsible

This Privacy Policy applies to frescoads.ai, related websites that link to it, the FrescoAds AI advertising platform, product support, sales activity and other services we provide (together, the “Services”). FrescoAds is the brand responsible for website, account, sales and business-contact data and is referred to as “FrescoAds”, “we”, “us” or “our” in this Policy.

When an enterprise customer submits personal data in campaign assets, prompts, connected systems or other Customer Content, FrescoAds generally processes that data on the customer’s instructions as a processor or service provider. The customer agreement and Data Processing Addendum govern that processing and take priority where they conflict with this Policy.

Information we collect

We collect only the information reasonably needed to operate, secure and improve the Services.

• Account and business data, such as name, work email, company, role, team, market, billing contact and workspace permissions.
• Customer Content, including briefs, prompts, reference files, brand guidelines, product images, generated outputs, comments, approvals and configuration choices.
• Product and device data, such as feature activity, timestamps, IP address, browser type, device identifiers, diagnostic events and security logs.
• Integration data from advertising, storage, identity or other connected applications, according to the permissions selected by the customer.
• Communications, including demo requests, support conversations, survey responses and event participation.

How we use information

We use personal data to provide the Services, manage workspaces and access, generate and localize content, route reviews, maintain records, respond to requests, bill customers, prevent abuse, protect the platform, troubleshoot issues, improve product reliability, meet legal obligations and communicate about the Services.

• We do not sell personal data.
• We do not use Customer Content for cross-customer advertising profiles.
• Unless an order form says otherwise, we do not use Customer Content to train a shared FrescoAds model without the customer’s separate written authorization.

Legal bases

Where applicable law requires a legal basis, we rely on performance of a contract, legitimate interests in operating and securing a business service, consent where requested, and compliance with legal obligations. We balance legitimate interests against the rights and expectations of affected people.

AI models and connected applications

FrescoAds is designed to route selected tasks to third-party image, video, language and supported audio models. If a user chooses a provider, relevant prompts, files and instructions may be sent to that provider to produce the requested result. Connected applications may also exchange data according to the customer’s configuration.

Provider availability, retention and data-use terms vary. Enterprise administrators should enable only providers approved for their organization. FrescoAds will identify active subprocessors and applicable provider terms before production processing begins.

How we share information

We may share information with vendors that host or secure the Services, process payments, provide customer support, deliver communications, supply AI models or enable integrations. We may also disclose information to professional advisers, during a corporate transaction, to comply with law, or to protect FrescoAds, our customers or the public.

• Vendors may process data only for the contracted service and subject to appropriate confidentiality and data-protection terms.
• We do not permit vendors to use Customer Content for their own advertising.
• For enterprise Customer Personal Data, the applicable Data Processing Addendum and deployment documentation identify the relevant processing arrangements.

International transfers

The Services may involve processing outside the country where data was collected. Where FrescoAds processes Customer Personal Data for an enterprise customer, the applicable Data Processing Addendum governs the required transfer safeguards and deployment-specific information.

Retention and deletion

We retain data for as long as needed to provide the Services, meet contractual and legal duties, resolve disputes and maintain security. Retention depends on the data type, workspace configuration and customer agreement. Customer Content is deleted or returned after termination according to the applicable agreement, subject to limited backup, legal-hold and security exceptions.

Security

We use organizational and technical measures designed to protect personal data, including access controls, environment separation, logging, encryption where appropriate and review of service providers. No system is perfectly secure, and customers remain responsible for user access, source-file rights and the data they choose to submit.

Your privacy rights

Depending on location, people may have rights to access, correct, update, delete, restrict or object to processing, withdraw consent, request portability, receive information about sharing, or complain to a data-protection authority. Brazil’s LGPD and other applicable Latin American privacy laws may provide additional rights.

• Submit a request through the FrescoAds contact page and identify the organization or workspace involved.
• We may verify identity and authority before acting.
• Enterprise users should usually contact their organization first when FrescoAds processes data on that organization’s behalf.

Cookies and website analytics

The Cookie Notice is the authoritative notice for browser storage on frescoads.ai. At the effective date of this Policy, FrescoAds does not activate analytics, marketing or personalization storage on the public website.

Children

The Services are intended for organizations and authorized business users, not children. We do not knowingly collect personal data from children through the Services. If you believe a child has provided personal data, contact us so the situation can be reviewed.

Contact and changes

Privacy questions and rights requests can be submitted through the Contact page at frescoads.ai/contact. We may update this Policy as the Services, vendors or law change. Material updates will be identified by a new date and, where required, additional notice.
